The Court of Catanzaro, by a decree dated April 14, 2009, decided that the name Andrea cannot be attributed to a minor female.
The court stated that the name imposed on a child should correspond to his/her gender and that, unlike many other EU countries, in Italy, the name Andrea is attributed by tradition (and etymological meaning) exclusively to male children .
Articles. 95 et seq. of Presidential Decree 396/2000 foresees two different processes to amend the acts of the State: the amendment in cases where the act is not conform to legal and natural reality in such a way that has altered the status of a person; the correction when it is a material mistake of the act, that does not affect the status of a person.
In this case, the requested change affects the gender and name, recognition sign of identity of a person. So, it requires an amendment (see also Circular of the Ministry of Justice dated 16 March 2001, n. 1827).

Therefore, the state can intervene to make an amendment where the choice of the parents does not correspond to the interest of the minor and expose the child to derision.
